Commercial content licensing is probably the most misunderstood aspect of working with creatives. Most people understand the creative fee being charged for the time involved during a photo shoot or to write a piece of literature but have difficulty with licensing the content. Licensing is a way that both the buyer and seller of content can receive fair value. An artist will always argue that his/her work has infinite value because of the uniqueness of the content; whereas, the buyer will argue the work has some value in excess of the cost of the materials used to create it. Somewhere in between is the true intrinsic value.

In commercial applications, it is fair to say that the artist would not produce the work if he/she could not recover the business cost (including reasonable return on investment) of creating it. Additionally, the buyer would not buy it (for advertising) unless he/she expected the ads to generate sufficient sales to recover the cost plus add to profits. The value of the creative work can be narrowed to something above the cost to create and some percentage of the profit expected from the commercial use.
